What Does Kavanaugh's Ascension to the High Court Mean for Adult? (XBIZ)

LOS ANGELES — There’s no doubt about it: Justice Brett Kavanaugh’s ascension to the U.S. Supreme Court after a bitter confirmation battle heralds a new conservative era at the nation’s top court.
XBIZ asked a number of the adult industry attorneys about what Kavanaugh’s rise means for the business of adult, including whether the court will become aggressively conservative and make some unpopular rulings.
Here’s what [a few of them] had to say:
Gregory A. Piccionelli, Piccionelli & Sarno: "Now that Kavanaugh joins Gorsuch on the court there is a majority for going back and sticking to the local community standards methodology of determining obscenity when it is charged."
Corey D. Silverstein, Law Offices of Corey D. Silverstein: "The issue that the adult industry now must concern itself with is that Republicans now represent the majority of the Supreme Court and this may lead to more pro-government decisions that could hamper individual liberties."
Joe Obenberger, J. D. Obenberger and Associates: "The issue that probably will come before the Supreme Court during the next two years of great importance to the adult industry will be whether laws, regulations and restrictions placed on adult entertainment, when reviewed in court for compatibility with the First Amendment, should get strict scrutiny or the looser intermediate tier scrutiny in court... In the meantime, it would be pretty potentially dangerous not to comply with Section 2257, especially after the two most recent additions to the Supreme Court. It just might be disastrous."
